It is increasingly common for employers to ask new employees to agree to restrictive covenants, with the intention of preventing them from poaching clients or colleagues when they leave their employment. For such agreements to be enforceable, they must be no more restrictive than is necessary to protect an employer’s legitimate business interests; something of which employers are frequently unaware.
