Neil Johnston

I am a Partner and Head of the Employment team at Bolt Burdon.

I joined Bolt Burdon after 18 years in the City and I have a wealth of experience advising on all aspect of employment law for both employers and employees alike.

I have particular expertise in advising on complex, sensitive internal investigations and contentious discriminatory matters. My extensive litigation experience ranges from unfair dismissal (hundreds of cases!), discrimination and whistle-blowing Employment Tribunal claims to a number of reported cases which have tested the boundaries of Employment law in the High Court, Court of Appeal and Supreme Court. I also co-authored the Equality and Human Rights Commission’s Employment Statutory Code of Practice that is the Employment Tribunals’ reference point for interpreting the Equality Act 2010.

I also have a particular expertise in advising on employment matters where there is an additional regulatory overlay, including the financial services, health, pharmaceutical, police and sport sectors.

I am the author of Xpert HR’s online manual for HR professionals in the financial services sector and have advised clients on the FCA’s remuneration codes; the senior managers and certification regimes; and the provision of regulatory references.  I have also been quoted in the Independent and BBC website on sports related employment matters.

I work across a wide range of sectors, each with its own nuances.  In any one day I might be advising a recruitment business on the enforcement of confidentiality and non-solicitation provisions following a potential breach by a former employee; drafting the employment provisions of an outsourcing agreement; advising a major brand on redundancies and restructuring; advising tech entrepreneurs and innovators on setting up their business, gig economy and future working matters; or advising a chief executive on the terms of his/her departure from the business.

Outside of work, I have a young family and spend most of my time at kids’ parties, kids’ classes and being bossed around by my little girl!  I also enjoy the gym and football (when I can get there); gardening (when time permits); and the odd real ale (when I can negotiate a pass).
