The steps that we take


Whilst each transaction is different, we at Bolt Burdon have set out below an overview of some of the steps we take on certain transactions:

Assignment (Purchase) of an existing lease / Grant of a new Lease

  • Investigate the Seller’s (or as the case may be) Landlord’s Title, including any covenants, restrictions or other matters affecting the Property;
  • Ascertain whether third party consent (e.g. of a lender or superior Landlord) is required to the purchase / lease and, if required, ensure that the consent is obtained;
  • Carry out searches (for example to ascertain that the use and construction of the Property is authorised by planning permission). You choose the nature and extent of the searches undertaken on your behalf;
  • Raise enquiries of the Seller’s or Landlord’s solicitors to achieve a greater understanding of the more practical matters (e.g. service charge costs or identity of occupational tenants);
  • Negotiate and agree the documentation including the terms of the lease in a timely manner;
  • Prepare a written report for you on the Lease / title and any other relevant issues; and
  • Complete the transaction and deal with post completion formalities such as Stamp Duty Land Tax and registration at HM Land Registry

Assignment (Sale) of a Lease

  • Provide evidence of your title to the Buyer’s (or as the case may be) Tenant’s solicitors;
  • Ascertain whether third party consent (e.g. of a lender or superior Landlord) is required to the purchase / lease and, if required, obtain the consent
  • Deal with any enquiries raised by the Buyer’s or Tenant’s solicitors;
  • Negotiate and agree the documentation in a timely manner;
  • Prepare a written report for you on the documentation; and
  • Complete the transaction and deal with post completion formalities such as the discharge of mortgages and registration at HM Land Registry and Companies House.
