Success for our Real Estate Disputes team!

Helping a private client to save her home in a complex tri-party professional negligence claim

We were instructed by a distraught private client who faced losing half of her home. She had inadvertently signed it over to an ex-partner without a deed of trust in place following negligent advice from her former lawyer. When the relationship ended, the ex-partner claimed he was entitled to half of the property.

This was a complex case because not only did it raise technical issues of professional negligence and property law, it required a sensitive approach.

To save our client the financial and emotional cost of a trial, we successfully resolved the case at mediation, with our client retaining her home of 20 years. Thank you to Gary Webber Associates for facilitating the mediation and Jonathan Pennington-Legh of Field Court Chambers.

The settlement was a huge relief to our client who was finally able to start living her life again, and complete the building works which had been in limbo whilst the dispute was resolved.
